General Terms and Conditions for Consumers

The terms and conditions for buying and using the Festival Gift Card: ordering, delivery, validity, redeeming and your balance.

General terms and conditions for the purchase and use of the Festival Gift Card

Version: October 13, 2026

1. Who we are and which terms do we use?

1.1 Festival Gift Card / we: TicketGift B.V., trading under the name Festivalcadeau, Festivalkado, Festival Cadeaukaart, located at Favaugeplein 21-F57, 2042 TN Zandvoort, registered with the Chamber of Commerce under number 76673774. Website: https://festivalcadeau.com. Email: info@festivalcadeau.com.

1.2 Buyer: the person who purchases a gift card. A consumer is a natural person acting outside their business or professional activity.

1.3 Holder / you: the person who lawfully has a gift card and the associated security details at their disposal and is entitled to use the balance.

1.4 Gift card: a physical or digital Festival Gift Card with a unique card code and, where applicable, a PIN code or other security feature.

1.5 Balance: the available amount on the gift card, after processing of spending, chargebacks and any costs agreed in advance.

1.6 Acceptor: a participating organizer or ticket seller where the gift card is accepted for the relevant ticket order. A technical payment or ticketing platform is not necessarily itself the seller or organizer.

1.7 Redemption: using balance to pay for admission tickets to an event.

1.8 Promotional card: a Festival Gift Card issued in collaboration with a business partner and financed by that partner as part of a marketing or promotional campaign. With a promotional card, admission tickets can be paid for directly with participating acceptors, just as with a regular Festival Gift Card. The promotional terms announced in advance apply to the promotion, while mandatory statutory rights are preserved.

1.9 Promotional voucher: a promotional coupon or code financed by a business partner with which a consumer receives a discount or extra balance during the specified promotional period when purchasing a Festival Gift Card. A promotional voucher cannot be used directly to pay for tickets. The terms of the benefit are stated with the relevant promotion.

2. Applicability and responsibilities

2.1 These terms apply to the purchase of gift cards from TicketGift and to the claims against TicketGift associated with the gift card. When purchasing through another seller, the agreements with that seller also apply to that purchase. Your statutory rights against that seller remain in place.

2.2 You can review and save these terms before the purchase. For an online purchase from TicketGift, you will receive the applicable version with the order confirmation, in a manner that allows you to store it unchanged.

2.3 A gift card is transferable. Upon transfer, the validity, the remaining balance and the legally agreed terms of use remain attached to the card. Personal payment obligations of the buyer do not automatically transfer to the recipient as a result. Pass on the information about validity and use to the recipient.

2.4 TicketGift is the issuer of the Festival Gift Card and is responsible for fulfilling its obligations regarding the gift card. For the technical infrastructure and transaction processing, TicketGift uses Intersolve Technologies B.V. and other service providers. Engaging these parties does not remove our own statutory or contractual responsibility.

2.4.a TicketGift handles the financial settlement of successful redemptions of the Festival Gift Card. We remit the associated amounts to the relevant acceptor, directly or via the relevant payment or ticketing service provider, according to the agreed settlement periods and after deduction of any agreed fees. This settlement does not reduce the amount you paid for your tickets. To support our obligations regarding gift card balances, we hold reserved funds in a separate secure account in the name of TicketGift B.V. These reserves remain part of TicketGift's assets. TicketGift remains responsible for fulfilling its own remittance obligations, including when we engage service providers for this purpose.

2.5 You enter into the agreement for the purchase of tickets with the ticket seller named in the ordering process. The organizer is responsible for the event to the extent that this follows from that agreement and the law. TicketGift is not itself the organizer or ticket seller by virtue of processing a gift card payment.

2.6 Individual agreements take precedence over these terms. Additional promotional terms apply only if they have been made available in a timely and clear manner. Mandatory statutory rights always apply.

3. Ordering, price and delivery

3.1 Before ordering, we state the card value, the price to be paid, any additional costs, the validity period and the method of delivery. Total prices shown to consumers include any applicable taxes.

3.2 An agreement with TicketGift is concluded when we accept and confirm the order. An automatic notification that an order has been received is only an acceptance if this is evident from it. Obvious errors in an offer do not bind us if the buyer should reasonably have understood that there was an error.

3.3 The buyer checks the details provided, including the email address and delivery address. Report an error as soon as possible. We will help, to the extent reasonably possible, to correct it.

3.4 Digital gift cards are delivered to the email address provided. Physical gift cards are sent to the agreed address. The delivery period is stated in the offer or in the confirmation. If no period has been agreed, we will deliver to consumers within thirty days of concluding the agreement at the latest.

3.5 In the event of delay, we will inform the buyer. Statutory rights in the event of non-delivery or late delivery, including the right to dissolve the agreement and obtain a refund under the statutory conditions, remain in place. In a consumer sale, the shipping risk remains with us until the buyer or their designated recipient receives the physical order, except for the statutory exception for a carrier engaged by the buyer.

3.6 We may set reasonable order and value limits in advance. We will not amend an already accepted order solely because we introduce different limits afterwards.

3.7 If we deliver an incorrect, damaged or non-functioning product, we will repair or replace it free of charge in accordance with the statutory rules. A deviation from an agreed design does not give us license to deliver something other than what was ordered.

4. Activation and validity

4.1 The gift card is activated according to the instructions provided at the time of purchase. Keep the proof of purchase or activation. If a paid card has not been correctly activated, please contact the seller or us.

4.2 A regular gift card is valid for two years from the date of purchase, unless a longer period was promised before the purchase. If the card only becomes usable later due to a cause attributable to TicketGift, we will ensure that no spending time is lost as a result.

4.3 The validity is stated on the card or in the accompanying information, with a clear reference to the balance check on festivalcadeau.com. Via that balance check you can verify the current balance and the registered expiry date. An error in our records does not limit your actual rights.

4.4 For gift cards that legally fall under the minimum validity, we do not apply a period shorter than two years. The designation 'promotional card' does not change this. Article 8 governs additional promotional benefits and claim codes.

4.5 After a legally agreed expiry date, you can no longer spend the remaining balance. A period that has not been validly agreed or cannot be validly invoked does not lead to forfeiture on the basis of this article. Longer periods previously promised remain in place.

4.6 After issuance, the gift card cannot be topped up, except for corrections, chargebacks or an expressly offered option to top up.

5. Balance and spending

5.1 The agreed card value is placed on the card. This may differ from the price paid if a discount or bonus was agreed in advance. Shipping or packaging costs form part of the balance only if this is expressly stated.

5.2 The gift card is intended for the purchase of admission tickets via participating festivals, events and/or ticket shops. Consumption tokens, drink credit and other products are not covered. Whether ticket-related service fees can be paid with the card is stated before completing the ticket order.

5.3 The amount used is debited from the balance. In the event of partial spending, the remainder remains available until the applicable expiry date. Additional payment and combining multiple gift cards are possible to the extent that the relevant ticket shop supports this; the available options are stated in the payment process.

5.4 The range of events and acceptors may change. Mention of a festival or logo is not a commitment that payment can be made with the gift card for every edition, ticket type or sales period. Check the current information and payment options before ordering tickets. This does not limit any rights you have on the basis of a specific commitment or misleading information at the time of purchasing the gift card.

5.5 A gift card does not guarantee the availability of tickets, access to a sold-out event or exemption from age and admission conditions.

5.6 We ensure a spending offering that reasonably corresponds to what was offered at the time of purchase. If the balance can no longer be spent in accordance with the agreement due to a shortcoming attributable to us, we will offer a remedy or an appropriate solution. Your statutory rights to dissolution, refund and damages remain in place.

5.7 Balance is not exchanged for cash or a bank transfer upon request. This does not apply when you have a statutory or separately agreed right to a refund or exchange, for example in the event of valid withdrawal or dissolution.

5.8 Report an incorrect debit or an incorrect balance as soon as possible with the available order and transaction details. We will investigate this and correct established errors. Our records are a means of evidence; they are not decisive and do not shift the statutory burden of proof to you.

6. Failed payments and ticket refunds

6.1 If balance has been debited while the ticket payment failed, we will investigate this with the parties involved. If no successful payment corresponds to the debit, we will restore the balance without undue delay. Please provide the order number and the date and amount of the payment where possible.

6.2 Questions about tickets, cancellation, rescheduling or the performance of an event should be directed to the ticket seller or organizer. Whether you are entitled to a refund is determined by the agreement for the ticket and the applicable law. Payment with a gift card does not affect those rights.

6.3 If, after cancellation or another valid reason, a ticket refund is processed via TicketGift, we will return the portion paid with the gift card to the original gift card, except where substitute balance is provided in accordance with article 6.4. For this purpose, the consumer may request the necessary card and transaction details from the relevant payment provider and coordinate the refund in the form of balance on the gift card with Festival Cadeaukaart. We may ask you for the order number or other details enabling us to trace the transaction. This verification does not affect your statutory refund rights. A different refund method will be used where the law requires this or this has been agreed with the entitled party.

6.4 Returning balance to a still usable original card does not automatically change the existing expiry date. If that card has since expired, become technically unusable or does not offer sufficient opportunity to actually spend the refund, we will issue a replacement digital card free of charge for the amount to be refunded. The spending period of that card is equal to the remaining validity period that the original card had on the date of the ticket payment to which the refund relates. This remaining period is calculated in calendar days and commences for the substitute balance as soon as the replacement card has been provided to the holder and is usable. The expiry date is clearly stated upon issuance. In the case of multiple payments with different remaining periods, we calculate the period per refunded amount and make any separate periods transparent. A statutorily required longer validity or other method of refund takes precedence. If the calculated period does not offer a reasonable opportunity for spending, we will ensure an appropriate solution. Other, non-refunded balance on the original card does not thereby acquire new validity.

6.5 An additional payment via another payment method is handled by the seller or payment service provider responsible for it. There is no right to double compensation of the same amount.

7. Cooling-off period for distance purchases

7.1 If you purchase as a consumer at a distance from TicketGift, you may withdraw from the purchase without reason within fourteen days. For a physical card, we count from the day after receipt by you or your designated recipient. For digital cards too, we offer fourteen days from the day after receipt. Statutory extensions of the cooling-off period remain in place.

7.2 Withdrawal can be made by an unambiguous statement to info@festivalcadeau.com, by letter, via the online withdrawal function or in another statutorily permitted manner. You may use the attached form; this is not required. Send your statement within the period.

7.3 We will confirm an online withdrawal immediately in a storable manner and block the relevant balance. Do not use or share the card afterwards. Digital cards do not need to be returned. You must return a physical card within fourteen days of withdrawal, unless we confirm that blocking is sufficient. Return costs are borne solely by you as a consumer if we clearly stated this before the purchase.

7.4 We will refund within fourteen days of withdrawal via the same payment method, unless otherwise agreed without additional costs. In the event of full withdrawal, we will also reimburse the standard delivery costs. Statutorily permitted suspension until receipt of the return or proof of shipment remains possible.

7.5 Activation or digital transmission alone does not terminate the right of withdrawal. In the case of balance already spent, no double compensation takes place; settlement occurs solely on a valid legal basis. Use does not automatically mean loss of every right of withdrawal. The ticket agreement is not automatically terminated by withdrawal from the gift card.

7.6 The arrangement also applies to a gift card with a personal message or image. For business purchases and purchases in a physical store, there is no general statutory right of withdrawal. When purchasing through another seller, you report withdrawal to that seller.

8. Promotions, promotional balance and claim codes

8.1 Promotional cards and promotional vouchers are provided in collaboration with business partners within separately organized marketing and promotional campaigns. The business partner finances the promotional card or the voucher-related benefit. The promotions are intended to draw attention to the Festival Gift Card and to increase brand awareness. For each promotion, we state in advance which benefit you receive, who carries out the promotion and which periods and participation conditions apply, including any purchase conditions, minimum spending or additional payments.

8.1a A promotional voucher has a varying validity period from the date on which TicketGift issues it to the business partner, or in the case of direct provision, from the issuance by TicketGift to the consumer. If the business partner passes the voucher on to the consumer later, no new period begins. The start date and concrete final use-by date are clearly stated on or in the voucher and announced before participation in the promotion. For promotional cards, the validity period and any additional promotional terms are likewise stated in advance and on or in the card. This provision does not affect article 4 and mandatory statutory rights.

8.2 You use a promotional voucher within the period stated for the promotion when purchasing a Festival Gift Card in order to receive the offered discount or extra balance. Only with the gift card thus obtained can tickets be paid for. The final date for using the voucher and the validity of the gift card obtained are stated separately. A voucher period does not shorten any existing gift card balance or other statutorily protected right.

8.3 A different period or usage restriction may apply to a separate discount or promotional bonus, but only where this fits the legal nature of the benefit, has been clearly communicated in advance and is permitted by law. Article 4 applies to a promotional card that qualifies as a gift card.

8.4 The regular validity of article 4.2 applies to the full balance of a Festival Gift Card purchased with a promotional voucher, including the extra balance granted with that purchase. The voucher period and the validity of the purchased card are separate periods.

8.5 Promotional terms cannot exclude statutorily protected rights. An invalid restriction does not become valid by describing the promotion or the balance differently.

9. Safe use, loss and theft

9.1 Keep the card code and security details safe. Share them only with the intended recipient or via the official payment process. Do not post a readable card code or PIN on social media.

9.2 Report loss, theft or suspected misuse as soon as possible via info@festivalcadeau.com. After sufficient identification, we will try to block the card as soon as possible. Blocking is only possible if we can reliably identify the card.

9.3 We may request reasonable evidence of the right to the balance, such as proof of purchase, order number, card number or information about the transfer as a gift. The holder does not need to be the same person as the buyer. We do not request more personal data than necessary.

9.4 In the event of replacement due to loss or theft, the following applies: if we can establish your claim, we will transfer the still available balance to a digital replacement card. The original validity remains in place. Replacement does not make a legally expired balance valid again.

9.5 For replacement due to loss or theft, we may charge a maximum of € 5 including any taxes, not exceeding the reasonable actual costs. We state the costs in advance. Deduction from the balance occurs only with your consent; we never deduct more than the available balance. In the event of an error or shortcoming for which we are responsible, replacement is free of charge.

9.6 Balance already spent cannot be reissued without investigation. Whether TicketGift is liable for misuse or lost balance is determined in accordance with the law and article 12. This article does not exclude liability for our own shortcomings.

10. Fraud and blocking

10.1 We may temporarily block a card or transaction in the event of concrete indications of fraud, unauthorized use, a security incident or where a statutory obligation requires this. The measure is limited to what is necessary and proportionate.

10.2 We will investigate the reason within a reasonable period. To the extent permitted by law and compatible with security, we will inform the person concerned about the reason and the possibility to provide information.

10.3 If the ground for blocking ceases to exist, we will lift the block. Mere suspicion does not lead to definitive forfeiture of the balance. In the event of unjustified blocking by us, we will ensure restoration of lost spending time.

10.4 In the event of established fraud or a sufficiently serious contractual shortcoming, we may take the statutorily permitted measures. In the event of dissolution, amounts and claims are settled in accordance with the law. The rights of a lawful holder are assessed separately.

11. Disruptions and force majeure

11.1 Electronic systems may be temporarily unavailable. We take reasonable measures for availability and recovery. Not every disruption constitutes force majeure.

11.2 If, due to a disruption or blocking attributable to TicketGift, you are temporarily unable to spend, we will offer an appropriate remedy. If spending time is lost as a result, we will remedy that disadvantage to the extent necessary, for example by making the remaining balance available on a replacement card with an appropriate spending period. We do not thereby extend the existing card. Statutory rights to a different solution remain in place.

11.3 In the event of force majeure under the law, we may suspend the affected obligations for as long as performance is actually impeded. We will inform those involved where reasonably possible and limit the consequences.

11.4 Force majeure does not automatically invalidate balance. Statutory rights to dissolution and refund remain in place. Damages are owed only to the extent that the law or a separate agreement provides for this.

12. Liability

12.1 TicketGift is liable for shortcomings and unlawful acts to the extent that this follows from the law. For consumers, there is no general limitation to the card value and no blanket exclusion of damages.

12.2 We are not responsible solely by virtue of offering the payment option for the performance of an event, decisions of an organizer or a shortcoming of a ticket seller. This does not affect our own commitments, own obligations and statutory liability, including any liability for auxiliary persons engaged.

12.3 We are not responsible for damage that arises solely from circumstances that are for the account of the buyer or holder under the law. Any contributory negligence and the extent of damage are assessed in accordance with the statutory rules.

13. Personal data and custom designs

13.1 We process personal data in accordance with applicable privacy legislation. Our privacy statement on festivalcadeau.com states which data we process, why, with whom we share it and how you exercise your privacy rights.

13.2 Accepting these terms is not consent to marketing. Where consent is required, we request it separately.

13.3 If you supply your own image, logo or text, you must be entitled to have it used for the order. You grant us permission only for the use necessary to carry out the order. We may refuse manifestly unlawful content. Any liability for supplied material follows from the law; there is no unlimited indemnification for all third-party claims.

14. Complaints

14.1 Report complaints about the gift card via info@festivalcadeau.com or by post to TicketGift B.V., Favaugeplein 21-F57, 2042 TN Zandvoort. Describe the problem and include available order or transaction details. Do not send a PIN code if it is not necessary.

14.2 We will respond within fourteen days of receipt. If a substantive solution requires more time, you will receive an acknowledgment of receipt and an indication of further handling within that period.

14.3 Preferably report a problem promptly after discovery. This complaints procedure does not shorten any statutory complaint or limitation period and does not limit your access to the courts.

15. Amendment of terms

15.1 The legally agreed terms remain in force for an existing gift card. Publication of a new version does not automatically change existing rights.

15.2 New terms may apply to new purchases if they have been made available before concluding the agreement. Necessary statutory changes may apply to existing cards to the extent that the law prescribes this. We will not implement other adverse changes without valid consent.

15.3 An amendment does not unilaterally shorten the validity of an existing card and does not reduce the existing balance. The applicable earlier version is available free of charge upon request.

16. Applicable law and disputes

16.1 Dutch law applies to agreements with TicketGift. A consumer retains the protection of mandatory provisions of the law of their habitual residence where that protection applies under the applicable rules of private international law.

16.2 Disputes may be submitted to the court with jurisdiction under the law. For consumers, there is no mandatory exclusive choice for a court other than that permitted by law.

16.3 If a provision is or becomes invalid or is annulled, the remaining provisions remain in force to the extent that the agreement can continue to exist without that provision. An invalid provision is not automatically replaced by a provision that is equally disadvantageous to the consumer.
